All Infortrend products, including the product Customer have purchased from Infortrend, shall be subject to the latest Standard Warranty Policy available on the Infortrend website: https://www.infortrend.com/global/support/terms-conditions

Software

  1. Infortrend Technology, Inc. (hereinafter “Infortrend”) owns the copyright to all software available on these Site(s) (further referred to as “Software”). The Software can be used only in accordance with the license agreement (further referred to as “License Agreement”). The License Agreement is supplied together with the Software, or it is a part of it. Software supplied with the License Agreement cannot be installed without user's consent with License Agreement.
  2. Customer shall be responsible for maintaining updated version of the Software by downloading or obtaining from Infortrend, and installing designated updated code, including but not limited to firmware, microcode, basic input/out system code, utility programs, device drivers, and diagnostics delivered with Infortrend products. Customer is solely responsible for the accuracy and integrity for their own data, reports, documentation, and security.
  3. Software is provided exclusively to Customer for the usage. This usage is in accordance with the License Agreement.
  4. Infortrend makes no warranty or representation that the operation of the software provided with this product will be uninterrupted or error free.
  5. No warranty or assurance, express, implied, or statutory, is given by Infortrend with respect to the software, Infortrend’s services or any other matter, including without limitation all warranties of title, configuration. If not stated otherwise, Infortrend declare that the Software is provided “as is” without warranty of any kind, including warranty of appropriateness on specific purpose and warranty of not breaking other’s legal rights. The above exceptions do not break cogent legal assignments about damage incurred.
  6. Infortrend shall NOT be responsible for any interoperability or compatibility issues that may arise when (1) products, software, or options not certified and supported by Infortrend are used; (2) configurations not certified and supported by Infortrend are used; (3) parts intended for one system are installed in another system of different make or model.
  7. Disclaimer for third-party software:
    1. 7.1 Infortrend makes no warranty or representation that this product will meet customer requirements or work in combination with any software products provided by third parties.
    2. 7.2 Customers are solely responsible for downloading, installing or using third-party software and take full responsibility for the consequences thereof.
    3. 7.3 Infortrend is not responsible for any loss or damage of any sort resulting from the use of, or for any failure of, software or services provided from third-party software.

Hardware

  1. The following general terms shall apply in relation to hardware products (hereinafter “Products”) which are sold by Infortrend.
  2. The Customer may only use the Products as specified in the applicable instructions and manuals from Infortrend.
  3. Intellectual Property
    No rights are granted to the Customer under any of Infortrend intellectual property including but not limited to technology contained within the Products, patents, trademarks, Infortrend name, logos and any other proprietary information or technology of Infortrend (hereafter “Intellectual Property”). The Customer recognizes that Infortrend is the sole owner thereof, and the Customer covenants that it will not take any action, which might prejudice or adversely affect the validity or Infortrend ownership of the Intellectual Property. The Customer shall without undue delay inform Infortrend of any infringement of the Intellectual Property of which it becomes aware.
  4. Limited Warranty
    1. 4.1 All Infortrend storage products are shipped with 3 years Infortrend limited standard warranty.
    2. 4.2 All non-Infortrend products or non-Infortrend branded peripherals external to the Infortrend hardware products are provided “AS IS” without Infortrend warranty. However, non-Infortrend manufacturers and suppliers, or publishers may provide their own warranties directly.
    3. 4.3 Infortrend is NOT responsible for any interoperability or compatibility issues that may arise when (1) products, software, or options not supported by Infortrend are used; (2) configurations not supported by Infortrend are used; (3) parts intended for one system are installed in another system of different make or model.
    4. 4.4 Customer shall be responsible to advise its customers/ end users regarding the interoperability/compatibility, supported or qualified hardware/software by Infortrend before installation and shall contact Infortrend sales representative if any assistance is needed.
    5. 4.5 Customer shall take full responsibility for files and data transferred, and to maintain all appropriate backup of files and data stored on our products. Infortrend will not be responsible for any data loss as a result of using or accessing Infortrend products.
  5. Warranty Disclaimer
    EXCEPT FOR THE EXPRESS WARRANTY SET FORTH HEREIN, INFORTREND MAKES NO OTHER WARRANTIES OR GUARANTEES REGARDING THE PRODUCT, WHETHER EXPRESS, ORAL, IMPLIED, STATUTORY, ARISING BY OPERATION OF LAW, OR AS A RESULT OF USAGE OF TRADE, COURSE OF DEALING, OR COURSE OF PERFORMANCE. INFORTREND HEREBY EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OR WARRANTIES OTHERWISE ARISING BY OPERATION OF LAW, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRODUCT AND ANY OTHER MATERIALS AND SERVICES, AND WITH RESPECT TO THE USE OF ANY OF THE FOREGOING.

    INFORTREND WILL NOT BE RESPONSIBLE FOR ANY DATA LOSS RESULTING FROM ANY OF OUR PRODUCTS OR SERVICES, EITHER DIRECTLY OR INDIRECTLY, INTENTIONAL OR AS AN UNINTENTIONAL CONSEQUENCE OF OUR PRODUCTS OR SERVICES.

    THE REMEDIES STATED IN THIS DOCUMENT CONSTITUTE THE CUSTOMER'S EXCLUSIVE REMEDIES AND INFORTREND'S SOLE LIABILITY FOR BREACH OF THE LIMITED WARRANTIES SET FORTH HEREIN.
